NUFIT WELLNESS Agreement

By accessing or using this website, you agree to the terms and conditions below. If you do not agree, please do not use the site.​

Use of the Site

 

  1. You may use this site for lawful purposes only and in accordance with this Agreement. You agree not to use the website:

  • In any way that violates applicable federal, state, local, or international law

  • To infringe on the intellectual property rights of NUFIT WELLNESS, Kathy Ozakovic or others

  • To attempt to gain unauthorized access to any part of the website or its infrastructure

Media & Event Attendee Release Agreement (Public events only)

  1. Should you attend any live or virtual events by NUFIT WELLNESS, you agree to allow the use of recordings (audio, photographic and video) for post event production and marketing purposes. No efforts will be taken by the Practitioner to de-identify participants in such recordings.

  2. You agree to allow these recordings to be used in all forms of media and acknowledge that NUFIT WELLNESS has the right but not obligation to use, adapt, edit, mix, add to, subtract from, arrange, re-arrange, revise, or change the recordings or any part thereof, and combine the same with other performances and recordings of other performances of other persons.

  3. NUFIT WELLNESS may use the Client's likeness for future lecture, teaching, and marketing materials, and further other goods/services provided by NUFIT WELLNESS. Any testimonials posted publicly, shared at events, online, sent directly to NUFIT WELLNESS can be used for marketing and promotional resources.

 

Intellectual Property and Content Use​​

  1. Intellectual Property delivered by NUFIT WELLNESS can only be used for personal purposes and must not be plagiarised or used outside the program. Use of NUFIT WELLNESS Intellectual Property outside the coaching program must have written consent from NUFIT WELLNESS and must be referenced and credited to Kathy Ozakovic, known as KATHY O, founder of NUFIT WELLNESS. If improper use has been discovered, then you may be asked to leave the group/program and will also risk legal action.

  2. All materials on this site — including research reports, articles, graphics, logos, videos, webinars, and downloads — are the intellectual property of NUFIT WELLNESS and Kathy Ozakovic or its content providers and are protected by Australia and international copyright, trademark, and intellectual property laws. 

  3. You are granted a limited, non-exclusive, non-transferable license to download, view, and share NuFit Wellness content for personal, educational, or non-commercial use, provided you do not modify the materials and always credit NUFIT WELLNESS and Kathy Ozakovic as the source. 

  4. You may not: 

  • Sell, republish, or commercially distribute any NUFIT WELLNESS or Kathy O content 

  • Modify or create derivative works from NUFIT WELLNESS content without prior written permission 

  • Use NUFIT WELLNESS and Kathy O logos or branding without authorization

Research Reports, Webinars, and Other Free Resources

 

  1. NUFIT WELLNESS provides research reports, guides, booklets, workbooks, infographics, webinars, and other wellness content free of charge as part of its mission to educate and inspire. You may download and share these resources, but you may not reproduce, host, or republish them in full on other websites or platforms without permission. Link to the original NUFIT WELLNESS download page instead. NUFIT WELLNESS does not guarantee the accuracy or continued availability of its free resources and reserves the right to update or remove materials at any time.

Third-Party Links and External Content

 

  1. This website may include links to third-party sites for your convenience. NUFIT WELLNESS does not control or endorse these sites and is not responsible for their content or any damages arising from their use.​

Disclosures

You Acknowledge:

  1. The Client is fully responsible for their own well-being, including their choices and their decisions.

  2. The Client acknowledges and recognises that NUFIT WELLNESS does not diagnose or treat any mental disorders, and will not use NUFIT WELLNESS as a replacement for any form of therapy.

  3. If the Client is under the supervision of a professional therapist, they acknowledge that they have consulted with this person regarding the advisability of working with a NUFIT WELLNESS Practitioner and that this person is aware of the Client's decision to be mentored.

  4. Sessions are comprehensive and may involve all areas of a client's life, studies, work, and relationships.

  5. I, the Client acknowledge that I decide how to handle these issues and implement my choices. My Practitioner is my guide, not my decision maker.

  6. NUFIT WELLNESS is not a substitute for professional advice in the matters of finances, legal, medical, or business issues. Appropriate expertise is sought out should the Client need it. We agree that all decisions in these arenas are exclusively the Clients'. The Client takes full responsibility for their decisions and actions.

  7. The information is made available for educational purposes only, and is not intended to be a substitute for professional medical advice, diagnosis or treatment. You must exercise your own due diligence before implementing any recommendation and/or purchasing any product/service. Kathy Ozakovic and NUFIT WELLNESS are exempt of any and all responsibility associated with misuse or your own interpretation. Do not delay seeking medical or professional advice.

  8. You acknowledge and agree that the above warnings and disclaimers shall apply to all content and that you take responsibility for your own health and wellbeing.

  9. I, the Client understand that I am fully responsible for creating my own results and am willing to dig in, do the work and get the results.

  10. This clause serves as a waiver. With this waiver the client waives their right to bring a claim if they are injured or suffer damages due to their own misuse or misinterpretation of information provided.

  11. The Client acknowledges that the consultations are confidential with the following exceptions: If any evidence of illegal activity or the potential harm to self or others is disclosed, the Practitioner may have to inform the appropriate authorities and so be unable to maintain complete client confidentiality.

  12. The Client acknowledges the Scope Of Practice of a NUFIT WELLNESS Coach may require them to refer you to the Dietetic, Trauma Informed Breathwork and Lifestyle Medicine services of Kathy Ozakovic to ensure they stay within their scope and the Client is best served. You may choose to engage with specialised services offered at additional costs.

  13. NUFIT WELLNESS and Kathy Ozakovic will not be held liable for risks or issues associated with using or acting upon the information provided during sessions, including nutritional supplementation use.

  14. I, the Client must sign the Breathwork Waiver prior to participation in breathwork sessions.

  15. I, the Client understand that I am no longer just a product of my environment or upbringing. The way I choose to operate is my personal responsibility. I get to choose who I become.
